Terms of Service

Who you are contracting with
Nightshift Software is a trading name of Joe Tebbett, a sole trader based in the United Kingdom. There is no company: the person named above is the party you contract with, and "we", "us" and "Nightshift Software" in this document all mean that person. What these terms cover
These terms govern every service we operate. Today that means:
- Rolegend - An AI Game Master for solo tabletop role-playing campaigns.
- Masquerade AI - Customer support agents that follow process scripts you write. Not yet available to buy.
Each service also has a service schedule: a short document covering the things that are specific to it, such as what the service does, its plans and limits, and any content rules that only make sense for that service. A schedule is part of your contract with us. If a schedule and this document disagree about a particular service, the schedule wins for that service and this document governs everything else.

Two further documents apply to every service and are part of these terms: the acceptable use policy and the refund and cancellation policy. How we handle personal data is described separately in the privacy policy, which is a notice rather than a contract term.
Your account
You are responsible for what happens under your account, including keeping access to the email address it is registered to. Accounts are for one person. Tell us at support@nightshiftsoftware.co.uk if you think someone else has got into yours.
Our services are for adults. Each service states its minimum age in its schedule, and none of them is offered to children. We take an age confirmation at face value: we do not verify ages or ask for identity documents. If we learn an account belongs to someone below the stated age we will close it and delete its data.
Acceptable use
The acceptable use policy sets out what you must not do with any of our services. Breaking it is a breach of these terms.
Your content
You own what you create with our services, and we claim no rights in it. We need a narrow licence to run the service at all: permission to store your content, to process it, and to send it to the third parties listed in the relevant sub-processor list so the service can do its job. That licence exists only so we can operate the service for you, and it ends when you delete the content or your account.
We do not use your content to train models. Where a service lets you publish something deliberately, its schedule describes what that publishing does.
Output from AI models
Our services generate text and other output using large language models. That output is generated, not checked. It can be wrong, inconsistent, or at odds with what you asked for, and no part of it should be treated as professional advice of any kind. You are responsible for deciding whether output is fit for what you want to do with it.
Model providers set their own rules about what may be generated, and those rules can change and can cause a request to fail. Where a service constrains output deliberately, its schedule says how.
Plans, payment and renewal
Paid plans are subscriptions. They renew automatically at the interval you chose until you cancel, and the price and interval are shown before you pay. We take payment through Stripe. Card details go into Stripe's own hosted checkout and never reach our servers.
The seller for your purchase, and the party that issues your invoice and accounts for any sales tax or VAT, is: Stripe. Nightshift Software sells through Stripe Managed Payments, which makes Stripe the merchant of record: Stripe is the seller to you, issues your invoice, and registers for and remits any sales tax or VAT. Your rights against us for the service itself are not affected.

We can change prices. If we change the price of a plan you are already on, we will tell you by email before it takes effect, and you can cancel before the change bites rather than pay the new price.
Availability
We aim for the services to be up and working, and we do not promise a particular level of availability. Services in beta or early access will have outages, and their schedules say so. We may change how a service works, and we may withdraw a feature. If we withdraw a whole service, we will give you reasonable notice, a way to get your data out, and a refund of anything you have paid for a period you will not get.
Suspension and ending your contract
You can stop using a service and cancel a subscription at any time. We may suspend or close an account that breaks the acceptable use policy, that is being used to break the law, or where keeping it open would put us or other users at risk. Where it is reasonable to do so we will warn you first and give you a chance to put it right.
If we close your account for a reason that is not your fault, we will refund the unused part of anything you have paid.
Liability
Nothing here limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law does not allow us to limit. If you are a consumer, you keep every right the law gives you, and nothing in this document takes those away.
Beyond that, the services are provided as they are. We are not liable for content you lose by deleting it, for the consequences of relying on model output, or for a third party we depend on going down. Where we are liable, our total liability to you for everything connected with a service is limited to what you paid us for that service in the twelve months before the problem arose.
If you are using a service for business purposes, we are not liable for loss of profit, loss of business, or loss of anticipated savings.
Changes to these terms
We will update these terms from time to time. For a change that matters to you, we will email you before it takes effect. Carrying on using the service after that is how you accept it. If you do not want to, cancel, and we will refund the unused part of the period you have paid for.
Law and disputes
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. If you are a consumer living elsewhere, this does not remove the protection of the mandatory laws of the country you live in, and you can bring proceedings there.
